\u00e0 l&rsquo;extradition, constitue le cadre juridique de la proc\u00e9dure et des conditions dans lesquelles des personnes peuvent \u00eatre extrad\u00e9es de Belgique vers un autre \u00c9tat.<br><\/em><\/p>\n<\/div>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container custom-bullet uagb-block-f42bce33 alignfull uagb-is-root-container\">\n<p style=\"margin-top:0px;margin-bottom:0px\">Voici les principaux aspects de la loi belge sur l&rsquo;extradition :<\/p>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-affdc909\">\n<p style=\"margin-top:0px;margin-bottom:0px;text-decoration:underline\"><strong><u><strong>Base de l&rsquo;extradition :<\/strong><\/u><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>L&rsquo;extradition peut avoir lieu sur la base d&rsquo;un trait\u00e9 entre la Belgique et l&rsquo;Etat requ\u00e9rant ou, en l&rsquo;absence de trait\u00e9, sur la base de la r\u00e9ciprocit\u00e9.<\/li>\n\n\n\n<li>La Belgique a conclu plusieurs trait\u00e9s bilat\u00e9raux et multilat\u00e9raux avec d&rsquo;autres pays, dont le Trait\u00e9 europ\u00e9en d&rsquo;extradition.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-9b532452\">\n<p style=\"margin-top:0px;margin-bottom:0px;text-decoration:underline\"><strong><u><strong><strong>Conditions d&rsquo;extradition :<\/strong><\/strong><\/u><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>La double incrimination<\/strong>&nbsp;: L&rsquo;acte pour lequel l&rsquo;extradition est demand\u00e9e doit \u00eatre punissable \u00e0 la fois en Belgique et dans l&rsquo;\u00c9tat requ\u00e9rant.<\/li>\n\n\n\n<li><strong>Peine minimale :<\/strong>&nbsp;L&rsquo;infraction doit \u00eatre punie dans l&rsquo;\u00c9tat requ\u00e9rant d&rsquo;une peine d&rsquo;une certaine dur\u00e9e minimale, g\u00e9n\u00e9ralement d&rsquo;au moins un an d&#8217;emprisonnement.<\/li>\n\n\n\n<li><strong>Prescription :<\/strong>&nbsp;L&rsquo;action publique ou la peine ne doit pas \u00eatre prescrite selon les lois de la Belgique et de l&rsquo;\u00c9tat requ\u00e9rant.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-831161b6\">\n<p style=\"margin-top:0px;margin-bottom:0px;text-decoration:underline\"><strong><u><strong><strong><strong>Exceptions \u00e0 l&rsquo;extradition :<\/strong><\/strong><\/strong><\/u><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Infractions politiques :<\/strong>&nbsp;Les personnes ne peuvent \u00eatre extrad\u00e9es pour des infractions politiques.<\/li>\n\n\n\n<li><strong>Infractions militaires :<\/strong>&nbsp;L&rsquo;extradition n&rsquo;est pas possible pour les infractions consid\u00e9r\u00e9es comme des infractions militaires en droit belge.<\/li>\n\n\n\n<li><strong>Risque de violation des droits de l&rsquo;homme :<\/strong>&nbsp;L&rsquo;extradition est refus\u00e9e s&rsquo;il existe un risque que la personne soit soumise \u00e0 la torture, \u00e0 des traitements inhumains ou d\u00e9gradants, ou qu&rsquo;elle ne b\u00e9n\u00e9ficie pas d&rsquo;un proc\u00e8s \u00e9quitable dans l&rsquo;\u00c9tat requ\u00e9rant.<\/li>\n\n\n\n<li><strong>Nationalit\u00e9 belge :<\/strong>&nbsp;Les ressortissants belges ne sont en principe pas extrad\u00e9s, \u00e0 moins que des dispositions conventionnelles sp\u00e9ciales ne le permettent.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-9a6905cc\">\n<p style=\"margin-top:0px;margin-bottom:0px;text-decoration:underline\"><strong><u><strong><strong><strong><strong>Proc\u00e9dure d&rsquo;extradition :<\/strong><\/strong><\/strong><\/strong><\/u><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>La demande :<\/strong>&nbsp;L&rsquo;\u00c9tat requ\u00e9rant soumet une demande formelle d&rsquo;extradition aux autorit\u00e9s belges, souvent par la voie diplomatique.<\/li>\n\n\n\n<li><strong>D\u00e9tention provisoire :<\/strong>&nbsp;Le suspect peut \u00eatre plac\u00e9 en d\u00e9tention provisoire dans l&rsquo;attente de la demande d&rsquo;extradition.<\/li>\n\n\n\n<li><strong>Enqu\u00eate :<\/strong>&nbsp;Le procureur g\u00e9n\u00e9ral enqu\u00eate sur la demande et la chambre du conseil du tribunal de premi\u00e8re instance \u00e9value les conditions d&rsquo;extradition.<\/li>\n\n\n\n<li><strong>Appel :<\/strong>&nbsp;La d\u00e9cision de la chambre du conseil peut faire l&rsquo;objet d&rsquo;un appel devant la chambre d&rsquo;accusation.<\/li>\n\n\n\n<li><strong>D\u00e9cision minist\u00e9rielle :<\/strong>&nbsp;La d\u00e9cision finale de proc\u00e9der \u00e0 l&rsquo;extradition appartient au ministre de la justice, qui tient compte de l&rsquo;avis des autorit\u00e9s judiciaires.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<div class=\"wp-block-uagb-container uagb-block-982f02af\">\n<p style=\"margin-top:0px;margin-bottom:0px;text-decoration:underline\"><strong><strong><strong><strong><strong>Mandat d&rsquo;arr\u00eat europ\u00e9en :<\/strong><\/strong><\/strong><\/strong><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"margin-top:0px;margin-bottom:0px\">Au sein de l&rsquo;Union europ\u00e9enne, le mandat d&rsquo;arr\u00eat europ\u00e9en (MAE) est en vigueur et permet une proc\u00e9dure d&rsquo;extradition plus rapide et plus simple entre les \u00c9tats membres de l&rsquo;UE. Cette proc\u00e9dure remplace les proc\u00e9dures traditionnelles d&rsquo;extradition entre les \u00c9tats membres de l&rsquo;UE.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"margin-top:0px;margin-bottom:0px\">La l\u00e9gislation belge en mati\u00e8re d&rsquo;extradition est con\u00e7ue de mani\u00e8re \u00e0 concilier le respect des obligations internationales et la protection des droits des personnes soumises \u00e0 l&rsquo;extradition.
